how can i take any legal actions against public school system?

during a bomb treat, my cousin and his homeroom class was taken into a separate abandoned building for a couple of hours. some of the kids went to sleep and this kid decided to cover him with bean bags. the teacher didnt do a head count, forgot about him and he was locked in the room for hours until the janitor came to clean up hours later...........what actions should be taken?

1. you leave your kid in the hands of their teachers to keep them safe

so if a kid decided to beat up and killed another child while the teacher was present, no one is at fault right? because they're only kids. am i right? the teacher is not responsible for your child for the 8 hours?

    The teacher should say they are sorry, the child and family should accept.

    eventually there will be no teachers left if every parents' first inclination is to sue the school once anything remotely unpleasant happens to one of their children. there is no "damage" that occurs from being locked in there for a few hours.

    re: I don't have an answer but certainly your case that you mentioned initially can't be comparable to a child getting killed though. I have heard incidences though where school boards specifically outlaw teachers using force even to break up fights, so you're damned if you do damned if you don't I guess. We had a case in my home state of MN a few years back where a teacher used force to break up a bully harming a smaller child and he got fired because the bully's mom sued claiming that the teacher as a grown man shouldn't be putting his hands on her "child."

    Like i said, i don't have a middle ground solution but something is clearly wrong on both sides and the attitude of suing over everything isn't helping. I looked specifically on the surface of your situation and based on the nature of what really happened I didn't think legal action was necessary.

    It was an unfortunate episode, but there's no lawsuit here because there are no damages. If the child is in counseling to deal with issues caused by being locked in a room for several hours, then his parents might have a cause of action.

    why is that anyones fault but the children themselves though?
