Landlord says we didn't pay rent last year?

Our landlord came to our door and said that we never paid rent for July 2013, which we did. Now it's 8 months later and we don't have a copy of the money order receipt so we can't prove that we paid. They're threatening to seize property to recover what's owed but we don't owe them anything! It's just their word against ours.

I just don't understand because if they really think we didn't pay in July, why didn't we get this notice then? or in August even??

I called the tenants board here and they just said to make a response in writing describing everything that happened and when and give them a copy, which honestly will do nothing to help.

Anyone have any advice?

Sounds like you may have a dodgy landlord or its a genuine mistake.

If you took money from the bank to pay the rent the bank statement will show the amount and month. You can instruct him to double check his records it will show on his own account.

Landlords CAN NOT TAKE your property without a court order.

Do you withdraw cash from the bank to buy the money order? I know that's not proof that you in fact bought a money order, but you will possibly have a date of purchase of the money order.

If you're talking about a postal money order, the post office will not replace it unless you have the receipt. Also, you don't need to show any ID to buy one, so I doubt there is any way they can confirm that you ever purchased one. Other types of money orders (such as from a bank) may work differently.

If you use a debit card to buy the money order (which is possible at the post office or a bank) then the transaction record from your bank is pretty strong evidence that you bought one.

    1. They can't seize property.

    2. Try going to the money order place and seeing if you can get a copy of the receipt.

i think it will help to put it in writing.

common sense is in your side

any landlord would have given you a late payment notice, etc.

    fight this!

i hope you have a checking account by now and checks
