what happens if i dont pay the item on ebay?
so... i bid on a item, and the seller shipped the ipad to me before i even paid him. but now, im low on money, what happens if i dont pay? Can i be sued? what can the seller do. i already have the ipad

You can be charged with fraud because USPS or UPS will show the package as delivered. If you could not afford it, you should not have bid and since you cannot budget, the least you could have done was to return it unopened. Since you kept it, eBay will probably ban you from buying on eBay, after the seller files a complaint against you and shows proof of delivery. eBay will ask you for an explanation but, you haven't got one so, expect the worst - an eBay ban and they may decide to close your account and you could be charged with fraud too.

Yes you can be sued, you received property you did not pay for....it is called theft.
If you don't have the money, then pack up the item and send it back to the seller. You don't get to keep it.

can you be sued? yes
will you be sued? probably not, opening a small claims case in another state wouldn't be worth the hassle for the value of the item.
You can always just ship the item back which would be the right thing to do.
