I'm a renter with a lease can I evict my ex-girlfriend?
my ex-girlfriend and I have now broke up I want her out but she won't leave, do I need to get an eviction notice Or is that something the landlord has to get, I had the apartment with the lease long before she came around

If that's her residence, sorry, but she can stay there as long as she wants. You cannot force her to leave. You have no authority to evict anyone from a property that you are not authorized to lease (or sublet) to begin with, regardless you would need cause. "I'm not banging the broad anymore" is not cause.
If she's not a listed tenant, the landlord can't evict her either. Even if she was a listed tenant, the landlord can only evict her for a material breach of the lease agreement.
However, if you allowed her to move in with you and it states in your lease that if anyone moves in with you they are required to be added to the lease, the landlord CAN evict you and then you both go.

Local laws can come into play, so you should contact a local attorney or legal service.
If she's not on the lease and you were subletting to her, she's most likely your problem. You're the one who had the agreement with her. You'll likely need to provide her written notice to vacate, then proceed with an eviction in something like 45 days if she still hasn't left. Again, it depends on the exact agreement you had and local laws.
