Is it illegal for a company to spy on youÉ?
My company had an agreement with a judge for a special option. If the company feels that a coworker is doing something illegal that they have the right to spy on their personal email, smartphone and computer.
Now I am pretty sure that what that judge did is illegal and same for the company. Thing is my HR boss is very paranoid of his coworkers and thinks that I am doing something illegal which I am not and he even said that they are investigating me. Another thing is this is my sister in laws company. My brothers wifes company and her dad is the president. I brought this to their attention and my HR boss lied to them and denied the fact that he was investigating me. So what can I do about thisÉ I need some help here...

As John J.S. said, the 4th Amendment only restricts the government in collecting evidence, not people acting on their own accord. Thus, evidence collected by a private individual (even illegally) might be admissible in court. However, if there is collaboration between the government and the company, as in this case, the company is acting as an agent of the government and is hence bound by the 4th Amendment when it comes to collecting evidence.

US Constitution ONLY applies to government, not the nice warm cuddly corporations who data mine, put stroke counting software on your computer, print out ALL emails using their addy, etc, They pay your salary they can control your work life.
NSA wants the same power your boss has.
