Landlord charging me $300 to paint apartment after moving out....?
I just moved out of my apartment. I had lived there 7 years, and now my landlord is charging me costs to repaint. She is saying that they shouldn't have to repaint the walls after that amount of time, because she has the same paint in her own home and it doesn't need repainted. The paint is your basic flat paint they use in most apartments. There were crayon marks on the walls, but I went over those with kills, and informed her that her maintenance guys gave me a can of it to use. It doesn't state anywhere in the lease about anyone painting or repainting the walls. Everything could be covered with one coat of their basic neutral color. Anyone have any insight to this? We live in Ky.

Paint is wear and tear after 2 years in ANY residence. She cannot charge you to repaint after 7 years. Tell her you will be in contact with a lawyer, and she will back off.

Flat paint typically needs repainting at least every 5 yeas. In MA, the housing authorities that govern the Section 8 program require the landlord to repaint every 5 years.
If all you did was use Kilz (with a Z) to cover the crayon marks (flat paint cannot easily be cleaned, thus the need to repaint so often)

You should have made the landlord do the priming and repainting. You should have also made sure, in writing, that the landlord knew before you moved in.
I doubt it would hold up in court, but you never know for sure. It depends on the judge who hears these cases in your area.

If you changed the color the wall was when you first moved in will the kilts and it wasn't approved by your landlord then you do have to reimburse them for the painting they'll have to do.
Always approve work done with your landlord before doing it to avoid lawsuits and other legal matters!
