Can an 18 year old have sex with a 16 year old without going to jail?
My girlfriend is 18 and I am 16. We have been dating for a while now, and we both kinda want sex. She isn't doing it because she's a sex freak, and I'm not doing it because I want to get laid. We both really love eachother and honestly plan on spending the rest of our lives together. We are both Virgins. We also plan on moving in together over the next year. Basically, would she automatically go to jail? She lives in Ohio and I live in Pennsylvania. Thanks.

You need to check what the laws are in the state that you plan on committing the act in. Here is a link that outlines the statutory rape laws in all states. Not that I'm saying she's raping you don't take it that way. That is what it is called at your ages if both parties are consenting but one is of an age where they would be considered too young to have given consent, that would be you, but that age is different in different states. Look at the laws for your areas and determine if it would be an issue for you guys. Two years is nothing in a relationship when you're both adults, but right now only one of you is an adult. The legal consequences aren't your only problem. If you two really loved each other and wanted a future, you would wait. That would only ruin the relationship. Don't give up your future for something you think you want now. Trust me, wait. You aren't ready yet, you still have a lot to learn.

Seriously if you really cared for each other then you will wait until you are both adults and spare everyone the drama. Even if the age of consent may be 16 in Ohio she needs to focus on completing high school preparing for life as an adult and the very last thing she and her family needs is to deal with the drama of an accidental pregnancy. I say that because no form of birth control before conception is 100%. Maybe a vasectomy but still. My mother was taking birth control pills when she got pregnant with me. Condoms fail all the time. And at 16 and even 18 neither one of you have nearly enough life experience to deal with a relationship and trying to begin a self sufficient life. There's a high probability that at your age a relationship will not last a lifetime but a consequence of a decision like this will. And as a female she has a lot more power over the situation than you do as a guy. If you knock her up and she gives birth then it's likely that she and her family get custody and control over the kid. You get to pay for it for 18 years.
Sex is a luxury that comes with consequences and you both must be ready to deal with them whether the consequence is intentional or unintentional. That's a responsibility for making decisions as an adult.
