Ebay seller sent defective/damage macbook?

I bought a brand new Macbook for $1150 on ebay. After receiving it and using it for 28hrs, there were a black stripes going across the screen. I contacted the seller to check and see if this was a used or defective unit. The seller stated that it was new and it might have been damage during shipment. So instead of taking it back and refund me, the seller filed a claim with UPS. I already opened a case and escalated because the seller ignored me for days. So after a week the seller filed the claim with UPS, I did not receive any phone call, email, or anything regarding to the arrangement for UPS picking up the macbook. When I accessed my ebay account, EBAY CLOSED THE CASE in the seller FAVOR. I called and ebay said that UPS tried to contact me multiple times but couldn't reach me. When in fact, I did not receive any phone call or email. I did received one single email when the claim first open saying that UPS might have to inspect the package. So I called UPS right away, they said that someone came by to pick up the package but no one answered. I then asked why I was not notified before this arrangement??? UPS replied, "well.... you need to contact the shipper". So I then contacted the ebay seller again, he/she said that he/she left a message with the claim department. I haven't heard anything since..... Is there anything I can do now?

Update:

My debit card is linked to paypal. I am guessing I can do that same by calling up my bank and explain the situation.

    Did you purchase the product with your credit card through eBay? If so, file a claim with the credit card company and tell them you are not paying for the product. PayPal is an absolute joke when it says that you are "secure." PayPal does not stand by any of their claims and the scammers are always winning. I had a similar problem with PayPal and they didn't do anything. Finally, I called my credit card company and explained. They instantly made a case and I got my money back. Because of this, I now always purchase everything through my credit cards.

    If you paid with a credit card via paypal, file a claim with the credit card company.

    If you don't do this already for large purchases, you should start.

    You can attempt to file in small claims court.

    Besides that, you are probably out of luck.
