if you test positive for weed wen applying for a job...?
, and you have a medical card for it... are they still obligated to hire you ... i knw it might depend on the job, but in general..whats the deal with that?
first of all just because im asking a question about weed DOESNT mean i do it!! so no need for rude comments and i guess obligated was the wrong word ... the idea is that ppl use it for pain like lets say back pain...and they choose to work a job where they sit all day at a PC (instead of collecting ssid)...could that person still be hired since it is prescribed...

No one is ever obligated to hire you. They can choose to not hire you for any reason and not tell you why. Going beyond that, only 4 of the 16 states where marijuana is medically legal provide employment protections, anywhere else, it just doesn't matter what the employer does. And having said that, all four states allow the employer to ban the use of marijuana while working or in situation where the use of marijuana might cause a danger,

Lol...of course they aren't obligated to hire you. Why would they be?
Even in my state (Washington) where recreational pot is legal they can fire/not hire you.
Pot is legal. So is being drunk. So is having really bad B.O. or those off-putting ear stretchers. So is being rude and having bad references.
It is perfectly LEGAL to fire/not hire people for LEGAL behavior.
Got it?

Nobody EVER has any "obligation to hire you".
If they don't like the way you smell, or look, or sound, or don't like the habits you might have (smoking, burping, touching your hair), you might not get the job and there is absolutely nothing you can do about it.

Contrary to what you have been told, testing positive for weed would cause you not to get the job. Also, testing positive for weed after you have been hired, even if you have a medical marijuana card, is cause for dismissal. Weed smokers are not a protected group.
If you are so sick that you need medical marijuana, maybe you are also to sick to work?
