There is a discharge process for disability, but whether you would qualify depends on who the borrower is. This discharge only applies to the actual borrower, not to relatives of the borrower. So, if the loans are in your name, then you cannot have them discharged. But, if the loans are in your mother's name (as in the Parent PLUS loan), then they could be discharged.

This makes sense, because the reason that the loans are being discharged is because the borrower has a disability that prevents him from working and repaying the loans. Your mother having a disability would not prevent you from working, so the discharge wouldn't apply to you.

People who are applying for Social Security Disability benefits are often advised to hire an attorney, but that wouldn't do you much good when it comes to getting a student loan disability discharge. The regulations are very clear that the discharge only applies to a borrower who becomes disabled after the loan is disbursed.

No, it's a common urban legend.

Dang, you went to an nonaccredited tech school? I wish they would just shut these all down, they are scams. If you want to learn something, only go to an accredited community college, even if you just take 2 courses a semester!

You owe the money. A lawyer can't remove your contract with the school. You need to make payment arrangements.

This has nothing to do with your disabled mother. If you signed a loan contract when you were 18 (an adult) you owe the money. Try to work out a payment plan with the debt collector.

Just because your mom is disabled doesn't mean you dont have to pay for college. It may help get your scholarships or grants, but you still probably have top pay something, especially if its just a technical school. They are private businesses and dont answer to the state, so they are not required to give benefits to disabled families.
