Why does Hobby Lobby get to deny certain birth control to women but JW can't deny blood transfusion coverage?

Jehovah's witnesses are sincere in their belief. Many are willing to die than get a blood transfusion.

    NOBODY IS DENYING BIRTH CONTROL TO ANYONE.

    Any women or man can buy all the contraceptives they want from Walmart for $4.00 bucks a month

    Because the supreme court said so, based on the fact they said so. Scalia offered no legal justification for why it should only apply to contraceptives, and as the lower courts rule, we will see these new found business rights expanded to their logical extreme.

    Blood transfusions are lifesaving procedures. They are necessary for people with certain medical problems to remain healthy (or alive, for that matter). Birth control is NOT a necessary medication. People are not going to die without birth control.

    The decision in question has nothing to do with denying or granting access to anything. It has to do with the extent to which government may mandate how closely-held family-owned businesses spend their money.

    Government went one step too far regarding birth control in the ACA. It mandated not that employers are required to pay for birth control for women (and/or men), it mandated that employers are required to pay for twenty specific forms of birth control. Had the law merely required that employers are required to pay for birth control for their employees, there would have been no case.

    I lived in Germany for many years. Most larger employers provide their employees with a free lunch. In Bavaria, where I lived last, beer is defined as food, not a beverage. Imagine a law that required employers to provide food for their employees' lunches, and specified a menu of schnitzel and beer.

    Most schnitzel in Germany is pork. Muslim and Jewish family-owned businesses would be required to pay for their employees' pork, a violation of the owners' religious principles. Muslim and Mormon employers would be required to pay for their employees' beer, a violation of the owners' religious principles.

    Had the government stopped at requiring that employers pay for birth control, this case would never have arisen.

    A JW-owned family-owned business can, under this ruling, deny coverage for blood transfusions. The business must have at least fifty employees, be closely-held and family-owned, and provide health insurance for its employees.

    Please read the actual decision and do not rely on someone's rant to inform you.

    They cannot deny the SERVICE, only the presence of it in the insurance plan.

    The service can still be procured...the employee just has to foot the bill.

    I honestly can't see them wanting to. Even they believe in banking your own blood to use for your own transfusions. The last time I checked anyway. It's been a while, and their beliefs do fluctuate. One thing I've never seen them do is try to force their beliefs on others.

    Personally, I believe that this will come up eventually with a closely held company owned by Jehovah's Witnesses. And I believe that the SC should rule in the same way. It is not our right to judge the belief's of others. If you don't want to live with those restrictions on your coverage, don't work for the company.

    Also, Curtis 1911 is correct. There is NOBODY denying birth control to women, only coverage to pay for certain birth control in insurance policies.

    It's pretty obvious... It's that whole "right to life" thingy. Blood transfusions are life-saving treatments... Birth control is not.
