Can I still take legal action?

So back in October I signed up for a membership to la fitness. I signed up with my friend so between us they are suppose to make it 35 each per month. I had told them to charge me only on a certain date as well. So a month or so goes by and I notice they charged me before the day I told them to as well as charging me 45 dollars. My friend only got charged 25. My account wS overdrafts because they charged me ahead of the day I had asked them to. My account was negative so I went to settle it and found out that the guy who signed us up didn't split our membership right because he thought my friend would give me money but when we asked him what if we stopped being friends he obviously realized he messed up. So I settled it and told them to cancel my account. Come march, surely enough my account has been charged 3 times for the 3 months I didn't go to the gym because I had cancelled. My account was overdrafts five times because of it because of some 5 dollar charges they put on top of the membership fees. I went to settle this again and had found out that they had simply put a note into the computer to cancel my account but no one had actually done it. I called them and had them refund my money but the overdrafts we're still there. Here is the issue, I am a student and as such, class has had me busy so I only went to the bank yesterday and found out my account had been closed because I didn't make a deposit for the overdrafts in 5 months.
