Copyright confusion!?

Hi. I am going to upload a YouTube video, and I was wondering if it would be copyright if I used "Shelter Song" by Temples, even if I cited it at the end of the video and in the description? I think it would be copyright, but I remember in one of my computer classes that she said you just need to cite your sources as you would in an article or book.

    No, it would be copyright infringement because you do not have permission to use the song.

    The only times you would be ok would be if a) you DID have permission from the owners directly or b) the song was intentionally put out there with a message saying anyone CAN use it. In both these cases you'd need to give a credit in the video to say who owns it.

    But in your case, it doesn;t sound like you have permission, so you can't legally use the song, and if you were told otherwise by a computers teacher, they were very, very wrong.

    You can use certain types of works in class, but not to upload to YT, without a license. The good news is that the worst you can expect to happen is that your video will be deleted, although nothing prevents the copyright owners from suing you for up to $150,000 for "willful infringement", whether or not you make a dime on it. 17 USC 504. The last time I read about such a case was 2013, where a woman was sued in federal court for "sharing" 24 songs online without a license. The jury found her liable for $80,000 for each song, but it was reduced to $9,000 per song on appeal. Capitol Records v. Thomas. She was tied up in court for over 7 years.
