What is the procedure for evicting the disabled in Oklahoma for damages and they can't buy now. we need to sell. It's monthly, no lease.?

    In a month to month tenancy the landlord is required to give the tenant one months notice to vacate, and isn't required to give the tenant a reason for the demand to vacate (and for liability reasons I don't recommend you offer a reason either). The tenant is responsible for that last month of rent. It the tenant fails to vacate by the end of the last month you then must provide the tenant a 3 day quit notice which is pre-requisite before you can file for eviction at the county court house.

    The fact that the tenant is disabled makes no legal difference.

    If the tenants have a contract to purchase the house in force, with out an expiration date, you will need to get them to agree to void the contract or sue the tenant to have a judge void the contract.

    The eviction is the same for everyone, there are no difference in race, religion or other for an eviction to take place.

    If they are now saying they are in a position to purchase the house and you want to give them the opportunity to purchase the house, it would benefit you to draw up a contract of sale, indicating they are the buyers at a certain agreed on price. Make sure there is a clause that indicate they must have an approved mortgage loan in place within 20 days or so, or whatever date you feel comfortable in allowing them to apply for an be approved for a mortgage loan.

    Once that day has expired, they would be required to move. They will simply come up with excuse after excuse in order to prolong them staying there.

    As linkus states, the procedure is exactly the same. Being disabled has no effect one way or the other.

    No one at all is eviction proof. No laws make anyone "illegal to evict". In fact the opposite it true, the rights of the owner of the property protected.

    Ok, thank. They say that It is illegal for me to evict them. They pay the rent but are damaging the house and aren't buying it now like they said they would and we need to sell it.

    visit local renter/landlord sites for info.

    'disabled' has no bearing on NON paying squatters.
