What should I do?

My situation is, my brother and his girlfriend moved into the house I am renting and they are smoking weed (it is still and illegal drug in Ontario, Canada) in the house at times when I do have my two year old child and when i do not have my child. How it goes is that i get my child literally 50% if the time. I have been living in my parents second house as a renter for 11 months now. My brother decided he needs a place to live with his girlfriend and moved into this house. We are currently renovating the basement in which they where meant to reside, but the reno is ongoing so they are currently in my son's room, while my son is in mine. My brother insists that because he is paying rent and the basement reno is incomplete, which he is in no hurry to complete, that he has all rights as a tenant to smoke weed in the house regardless when i have my son. My parents have told him and his girlfriend a few times to not smoke it in the house but they disregard what was been said.

Should I call the police on them the next time they smoke it in the house. Should I take the risk of Childrens Aid Society being called in because the illegal substance is being used in the residence of a child? The last thing I need is CAS being called, but I do not know what else to do. My brother is not listening to me when I say to him that i cannot have it smoked in the house.

Update:

I am currently looking for a new place. Not easy since unfortunately i am currently on social assistance. I just finished one year of college and took out a hefty student loan and can not afford to take a second hefty loan out. I have a few places of employments but they did not end up working due they dont want any more people in the union and only wanted summer season work.

In the mean time do I call the police tho. My parents are the landlords but dont want this to escalate.I need them out

    You need to move, pronto, before you lose access to your child. You are right to be concerned on all fronts- they cannot be near you, and at the moment you will be seen as allowing your child to be in a residence with illegal drug activity. You need to get out NOW. No ifs, and or buts...and find another place to live. Wish it were different- this isn't fair.

    If you are renting the house, talk with the owner of the home and then make arrangements with them to have the locks changed. Send an email or letter to your brother stating that they can make arrangements with a suitable third party to pick up their belongings for them. If are free to make a complaint to the Ontario Residential Tenancy Branch, but since their names are not on the lease/rental agreement and they are family members, the ORTB won't touch them. If they wish to call the police... you'd be happen to allow an officer in while they pack their personal belongings... including their illegal drugs.

    Tell them there won't be any weed in your house, period. It's your house and if you say they have no right, then they don't. And that's coming from a pot smoker. If they can't have any respect they can hit the road.
