I am being evicted?

If I'm being evicted and don't pay my last month's rent can I still get my security deposit back?

    Most likely you will not get your security deposit back. The landlord will use your money to cover any rent you didn't pay, any late fee's you didn't pay and any damage.     No. They'll keep it instead of the rent you owe. You took out a legally binding agreement in the form of your tenancy agreement so you'd have to pay the money one way or another.

    Remember, you'll find it very hard to find a future place to rent if it shows on your record that you defaulted on your rent in the past.

    No. That's why they took the security deposit in the first place. In case you fled. If there are damages, they may chase you down for that.

    No. Your security deposit will be applied toward any damages and then toward any unpaid rent.

    If you owe more than that, you can be sued for the balance.

    If there is money left over after any damages and outstanding rent are paid, then you get that as a refund.

    Of course not, any money you owe the LL comes out of the deposit.

    Why would they send you money if you owe them money?

    Even if you got it back - if you had NO damages at the apartment - they will sue in for the rent you owe.
