Do my parents have the right to withhold stuff that I buy with money I don't get from them?

I am 17 years old and will turn 18 in December. My question is in regards to my phone. I have had my phone service for 2 years, paying for it with money I make at my job. My parents are not on the account, but they make me leave my phone on the kitchen counter at night and refuse to allow me to take it to school or to have it in my room.. I bought my phone and didn't tell them about it and got caught, and I understand that it was a mistake on my part; however, that's beside the point. Do they legally have the right to keep my phone away from me or is it theft?

    Being an ab student makes no difference. You can still F up major given the right circumstances. The fact that you got and tried to sneak in a phone is reason enough to give them a red flag about why you had to get it. A parent can withhold anything, including money you make on your own, from you until you are 18. You are legally a child and the responsibility falls on your parents.

    Generally speaking your property rights aren't recognized until you're 18. Any money you earn is coming about because they're legally obligated to provide you food and shelter, health care, education, etc.

    As long as what they do with "your" property isn't outright abusive, they can withhold things like cell phones, video games, you name it. If Child Protective Services comes knocking, they mainly just need to be able to explain why what they're doing is in your best interests, even if it's just teaching you not to sneak around and buy things when they told you "no."

    Anyway, yes, they absolutely have the right to withhold stuff that you buy with money you don't get from them. When you're 18, it's "yours." And when you're 18, your parents no longer have any legal obligation whatsoever to provide you food, shelter, health care, whatever. So watch it.

    Yep, they have the right....and respect them for it....they are doing what they think is "right" for you. You do not need your phone 24/7...although you think you do. You go to school to learn.......they don't want you up all night on your phone either....someday you will understand....they care about you....many parents don't care about their kids and what they do...be thankful

    Because you are not 18 you have no legal right to property. They could throw the phone in a fire place and it would still be legal, even if you paid for it.

    It is not there's to take

    Although they are your parents I do not think they do if your the one who saved and got it with your own money.

    You are a minor child. You own NOTHING yes, its legal
