Can a dog breeder sue me?
The dog breeder said she would sue me for harassment because I sent her four emails (all of which she replied to). She did say in the last one to stop bothering her and I replied to it.
All I wanted to do was say my piece that I was not happy about her judging me so quickly. She refused to sell me a dog because I asked how much she sells them for. I just wanted to know to save up enough because, because I did go through her website and she was the best quality breeder that I felt i could trust the most.
Can she actually sue me for this? I am in Ontario. I know I can just reply to her suit with a discrimation claim but still. Do I wanted to do that? Not really.

I don't think she will sue you. Did you explain to her, as you did here, that you only wanted to know the price because you wanted to know how much to save up for, and that you thought she was the best breeder around? if you did, she is probably feeling pretty embarrassed right about now. But don't email her again. Find another, better breeder.

I'm pretty sure if you just stop emailing her she won't bother to take you to court. However, depending on what you said and what she said, she possibly would have a case. Either way, she's clearly not going to sell you a puppy so you might as well save the both of you further aggravation and stop communicating with her.
As to your proposed countersuit, I don't know what the laws are in Canada, but I'm fairly certain you couldn't win. Breeders are not businesses, they are allowed to discriminate against any potential buyer for any reason they choose. If you showed up to see her dogs and she didn't like the color of the car you were driving that's a good enough reason for her to refuse to sell a puppy to you and there's nothing you could legally do about it.
And FWIW when contacting future breeders, it might be a good idea to do some more research on the breed you are interested in so that you know how much a puppy from a good breeder generally goes for. And I certainly wouldn't start a communication with a breeder by asking how much their puppies cost. Many of them have it somewhere on their website. And even if they don't, there are a lot of other questions that should be far more important to you than price, such as health testing, etc.

Anyone can sue anyone. But if she did sue, she'd lose, unless you threatened to harm her in your 4 e-mails. She just said she'd sue so you'd leave her alone. Which is what you should do. If you continue to e-mail her now that she has asked you not to, be aware that at some point it could be considered cyber-stalking, which IS illegal.

Well again, anyone can sue anyone. But you would lose. Not selling you one of HER dogs is not considered discrimination in the legal sense. She wants the best possible homes and if in her opinion that's not you, then she's entitled to have that opinion.

WHY??? Who cares? It's not like you had any hope of changing her mind--if anything, you just proved to her that she made a wise decision.
LEARN from what happened. Leave this breeder alone, Find another one and don't "force" yourself on her.

As a dog breeder I listen to what a prospective buyer has to say and if I don't like what they say they do not get one of my pups .
We put a lot of time and effort into breeding good sound litters of pups and we want them to go to the best homes that are available as there is in our opnion nothing worse than selling pups to people who may not look after them properly or are "fad" buyers .
If anything the breeder could sue you for harassment why she would bother I really could not say but more than likely would not so as others have suggested move on .

A couple of people stated that you can get sued for pretty much anything...yes, people sue for stupid reasons. However, unless you threatened her in the email, there is nothing you should worry about. Plus, I don't think she would even care about (or have time for) suing - I'm sure she cares a lot more about taking care of her pups and selling them to good families.

So, stop emailing her! She doesn't want to sell you a dog...period. It's HER litter, and she can sell a puppy to who she wants to or NOT. Stop bugging the woman. You may have went to her website and found her as a good breeder, but that doesn't mean that this breeder trusts you to be an owner of one of her pups! Give it up! I use to show and breed dogs, and was harassed a lot by people who I wouldn't sell a dog to. This breeder IS judging you, and you've given her reason to, so just STOP. Move on to another breeder, and see what they have to say. When a person is looking for a quality puppy, they know how much they plan on spending for one. HOW MUCH is NOT the question you want to ask of a reputable breeder. IF you want that puppy from them, and you want it that bad, then you pay them that price, even if it's a PET quality puppy that costs $3,000.00., but that doesn't mean that the breeder would sell you ANY puppy at all, even if you were to give them $5,000.00. Reputable breeders have a passion for what they do, and no money on this planet can buy a puppy that they don't want to sell to YOU
Don't be desperate. No reputable breeder would sell to you.

Stop emailing the breeder. She doesn't want to sell you a dog. It's her litter, her time, money and heart she put into it.
I had someone call me about my litter of wire dachshund pups and in our conversation, she started telling me how her current dachshund is 50 lbs and on diet food and started giggling about it. I flat out told her she wasn't getting one of my beautiful pups. A 50 lb dachshund is a morbidly obese dachshund and that say alot about that person's dog ownership.
When people called me, I expected them to know something about the breed, not that I have to spoon feed them info. That shows me no research was done.
I'm generally happy to give my time and talk to someone about my dogs, the pedigrees, the titles and the health testing I had done. Then, we'll talk about what your looking for and if I have what your looking for.
I had someone come up from Fla, didn't blink an eye at the price of the pup, flew up to NY, took car service to my place, had lunch, took car service back to the airport and back to Fla all in the same day.

I'd like to know what you said to this breeder word for word after telling you to stop. Did you name call, or threaten her? I wouldn't be concerned unless you did either of those. If you listened to her, you wouldn't be in this mess. Replaying to her after she clearly tells you to go away won't change her mind to sell you a puppy.
She probably didn't feel like you were the right home for 1 of her pups. Coming back to tell her not to judge you is only adding fuel to the fire.

Anyone can sue for just about anything these days.
Doesn't mean she'd win.
Sounds like either she's a nutjob, or you are and not telling us. Either way, she has a right to pick and choose who she sells to, it's not like anyone is entitled to buy a puppy just because they want it. And if you didn't sign anything or put down a deposit, you're SOL.
Cut your losses and move on
