If the biological dad is not on the birth certificate...?

I was reading a question on one website where one person made this statement:

"okay so if your fiance just signs the birth certificate, then yes he has rights. But if at any point in this childs life the bio father changes his mind, can't he just have a paternity test done and can fight for his rights?"

And I got wondering, what is the answer to that question?

No one gets rights just for signing the AOP (no one signs the actual BC). Unwed dad's need a court order.

Biodad can come back an attempt to assert his place. However if the other man has acted like dad, raised the child, cared for the child, and is the father as far as the child knows, most judges won't break that bond. DNA is not fatherhood, it's just biology.

It's perjury to sign a declaration of paternity if you know you in fact are not the father, though I have never in the real world personally seen any serious consequences for doing it (this is in California).

The real biological father can assert his parental rights at any time.

The biological father at anytime can step forward and demand the right to have access to his child. the kid could be 16 0r 17 if the father wants it he has that right.period.Plus if the mother seeks child support from health and welfare. they will go after the father for the money, its a given.

Yes, the biological father could file a custody case, during which a DNA test would be done.
