How long should I wait for the rest of my deposit?

I moved out in Sept 2014 and for a month my deposit was lost in the mail (USPS fault) and then I finally got a check for most of my deposit but it was short $100 so I told them that I was supposed to get an extra $100 and the company agreed.

They "sent" the $100 in the mail and it never came so I drove down to SoCal to notify them (Dec) and then I was told that the week of the 20th they would send a check for the $100. Now it's Feb and I still haven't gotten it and I've tried emailing but haven't gotten a response. I haven't cashed the original check because I wanted to do it at the same time.

How long should I have to wait for this? Thinking about telling them I'm going to take legal action so they can get their act together and send my $100.

    If you threaten legal action, it's just going to give an excuse to not interact with you further. They're going to sit back and wait to hear from your attorney. Simultaneously, they know you're probably not going to pay an attorney to talk about $100. You'll just dig yourself a hole.

    It sounds like you had a problem the first time with a USPS delay. The same thing may be happening again.

    In the meantime, you have a check from around September you haven't cashed. Very often similar checks are good for only a limited period, like 90 days. The check should say on its face. You might want to cash that already rather than sit around waiting for your $100.

    If you really want to go sue them over $100, have fun. In the meantime, you should probably send them another letter reminding them you haven't received this. And again, why they heck are you still sitting on the original check?
