I have a friend who was arrested for DUI manslaughter (2) counts and DUI impairment property damage. Can this be done?
JUDGMENT:
Count 1: DUI manslaughter ordered to serve 11 years with a minimum mandatory sentence of 4 years pursuant to FS 316.193.3C, concurrent with all counts in this judgment.
Count 2: DUI manslaughter ordered to serve 11 years with a minimum mandatory sentence of 4 years pursuant to FS 316.193.3C, to run consecutive to Case number ??, count 1
I need to know how the wording being used is correct.
Count 1 concurrent with all counts in this judgment.
Count 2 consecutive to count 1.

If that's how he was sentenced, then the obvious answer is yes they can. If you want an actual legal opinion then contact a lawyer in your area. You aren't going to get any real lawyers coming on here and giving legal advice about a case they know little to nothing about. Most states have a lawyer referral service that gives the names of lawyer who do a 30 minute consultation for free. Check with your state offices to see if one is available in your state.

I suspect you extracted PART of the ruling, and the part you left out is actually CRITICAL to understanding the actual sentence.
The one thing that is certain is that he won't be eligible for a parole hearing for at least 4 years, possibly 8. The total sentence is between 11 and 22 years.
I GUARANTEE the actual sentence is legal. What isn't clear is what that sentence is.

He killed two people and will walk in eight years...not bad for a drunken murderer ...he's lucky to love on america. In many places he would have been beheaded and the families of his victims given his personal property.

Are you asking if they can be sentenced to that? Because yes. They can.
