Being "unlawfully present" in the United States is only a civil infraction, like you not putting a dime in the parking meter when running into the Starbucks to get a cup 'o java. People who enter the United States "with inspection," so with a visa or as part of the Visa Waiver Program yet overstay their welcome are out of status, which means pretty much nothing, as it' not a crime.
An illegal alien, by definition, is a foreigner who entered the United States without inspection (EWI), totally under the radar, by climbing over a fence or wall, swimming through the Rio Grande, or hiding in the trunk of a car. Thus, about 93% of all illegal aliens in the United States are Mexican nationals. The rest is from Central and South America. Only a negligible number (less than 1 tenth of 1 percent) come from other parts of the world. Entering the United States without inspection is a misdemeanor, which is a crime. All illegal aliens are thus criminals whereas visa overstayers are not.

If you can't prove you have the legal right to be here then yes you are breaking the law simply by being here.
