Can I press charges against the driver who hit me while riding my bicycle? - Texas?

I was riding my bicycle down the sidewalk (of a busy street). A woman was exiting a car dealership. She barely slowed down as she closed in on the sidewalk and got close to the street. She bumped into me, causing me to fall onto the street, luckily, there was no traffic. She wasn t going that fast, so she didn t hit me too hard. I basically left with a scratch on my knuckle.

She pulled back into the dealership and waited as I called the cops. She was very concerned and seemed quite nice. However, I still am very angry at the entire incident.

I felt the officer was quite useless. He asked what happened. I gave him a quick version of events. He asked about the condition of my bike, which was slightly damaged. He then asks for an ID from each of us, goes to his car, and comes back about ten min later.

I try to elaborate on what happened. He has no comment, doesn t seem to care. He says we re both free to go and that s it. I try asking him about pressing charges, and he asks why?

I tell him because I was injured and my bike is damaged.

He says no criminal activity occurred.

...pretty much what happened.

I just feel like I was assaulted and it s a bit odd that this lady hits someone with a car and just gets to drive away.

I got a quote from a nearby bike shop saying it would be about $40 for a part to fix it (not including labor).

lol, awesome, I should have known there are nothing but idiots on yahoo. People here are mentally challenged, have little reading comprehension, and are barely knowledgeable in the fields they post in.

If you actually can read, you would see that the point is that a driver hits someone and a lazy police officer can care less. You have assault who gets a free pass, will likely end up killing someone eventually, versus a civil servant who doesn't like paperwork.

Update 2:

You usually don't feel injuries immediately-adrenaline. I could end up hurting tomorrow.

    NO, you CAN'T press criminal charges ANYWHERE in the US. ONLY the DA can press charges. You can file a criminal complaint, which won't do you any good, even if she was convicted. You can file a civil lawsuit, but for the amount in question, even if you win the lawsuit with coast your more than your damages.

    You should have been more careful if you were riding across a driveway.

    Of course you CAN sue, but that seems like a waste of everyone's time.

    You were not assaulted. Most places you shouldn't have been riding on the sidewalk in the first place.

    Sure you can sue. But don't be surprised when you end up losing and paying HER court costs.

    Wasn't a criminal offense. She bumped you. Next time watch it.

    So you want to file a complaint for a "scratch" on your knuckle and forty dollars worth of damage to your bike?

    Put your big boy pants on and pay for the bike yourself.

    what do you want? damages for a scratched elbow? good luck. juries do not award settlements without just cause. you can spend money on a lawyer but he will want the fee upfront
