Stolen Property in possession of an Attorney?

Update:

My Son's cellphone was stolen by his ex girlfriend. He filed charges on her and she gave the phone to her Lawyer before she was arrested. Her Lawyer will not return the phone because he says it has incriminating evidence on it. The phone legally belongs to his Mother. Can the Attorney be charged with Receiving or Possession of Stolen Property? Can an Ethics Complaint be filed? This is in Mississippi. Please site any Case Law or Precedents if you know!

    If it is in possession of an Attorney it will be released after the trial
