Regarding right for claim of real estate property.?

For over 3 decades my mother rented/leased a private lot property and built a house there and she's paying the rentals for many years. However, due because that property is also being disputed between owner and another, my mother discontinued the payment. And now, the same owner claims that property and wants my mother to leave. Does my mother have legal right for ownership of that property since for years she's been paying the real property tax too, apart from the rental?..Please advice. Thank you.

    She has no claim whatsoever on the house. The owner of the property is the owner of all structures on it. Since your mother stopped paying her rent, it sounds like she has been asked to leave, as a precursor to an eviction. If she leaves willingly, she will be better off. An eviction on her record will mean she cannot rent anywhere else and she will also end up owing a lot more than if she had just moved out when asked to. Paying property taxes can be negotiated as included in the rent or separate, paid by the homeowner or by the tenant. It is up to the owner and the tenant. It has nothing to do with owning the property. The owner is the one with legal title. Your mother was simply a renter and when she failed to pay her rent on time, she was asked to leave. If she does not, she will be evicted. Plain and simple.

    Your mother would have no claims to the property,or at least the land.

    By your mother paying the property taxes does not give her claim to the property. The tax collector would not care who is making the tax payments as long as they are paid.

    Your mother is not able to claim she lived on the property in an adverse condition, because the owner of the property knew she was living there and collecting the rent your mother was paying.

    Since the lease or any other agreement might not have covered the house, you mother built, she might be able to claim the house. However, she would be required to move the house at her expense.

    Why did your mother not place the rent in a bank of her choice to save and pay the rent when the dispute was settled?

    By the owners being in a dispute over ownership, does not prevent your mother from paying the rent she agreed to pay.

    She would never have any claim to ownership of the lot Stopping the rent payments was her second mistake.

    She has paid taxes on her house and on the property the house sits on. That is considered a privilege she has

    been able to enjoy all these years. She has never had to invest in or pay for, any actual land.

    All leases have stated terms. At the end of a term, the owner can legally terminate the lease and require the

    tenant/ house owner to move off the land.

    Her only solution now is to hire a house mover and move the house off the land after she finds a lot to move

    it to. Otherwise, she can try to negotiate with the property owner and sell it to him. Or, if he agrees, she can

    leave it there, and move her contents out by his required date.

    Time to get a lawyer. If she's built the house and has been paying the property tax, and can prove it, she may have some partial claim to the property. She should at least make a claim for the improvements (the house) and the taxes she paid, if they were not a part of the rent agreement.

    rental is different than ownership. If your mom is on the deed they can not do a thing. Why would she be paying the taxes is beyond me. She can get that money back for the owners. File a law suit regarding that.

    Your mother has no ownership on a property that she was renting, regardless that she paid the property tax. The only way she gain ownership is to purchase the land.

    She doesn't own the land and never did and is aware that someone else owns it. Why wold anyone build a house on someone else's land? Evetually there has to be a problem.

    you cannot build property on land you don;t own - she will need a lawyer
