A few weeks ago hes been a real jerk an even sprayed me with pepper spray so after he told me too go outside I said ok hold on an got some pepper spray an sprayed him an he attacked me an I told him we are even. An then he grabs me on my neck squeezes an then lets go an calls me a pussy a goes. Im a lover not a fighter. Im toned I just dont know how too fight. My stepbrother told me too hit him in the leg with a peice of wood. I didnt. Maybe I am a pussy. What should I do? I wanna kick him out but I cant do it on my own. You've got a serious problem on your hands. In the beginning, I was thinking of answering with, "tell him to move out and if he refuses and/or it turns into a violent altercation, call the cops", but that would be a huge mess. Maybe it would be best to discuss this with your family in private. I don't mean your step brother but the people who are receiving your roommates monthly pay for staying at the house (if he is paying to live with you and yours). They should support your decision considering you're family and that they'd (hopefully) want you to be comfortable living in your own house. If talking with them doesn't help, then my next best answer would be to either (if you're old enough; are secured financially) move out or fight back. Tell the roommate that he is staying in your family's house under their care and that he has no right to treat you like that or he can move out.

You can't kicked him out legally. He has established residency. You would need to evict him. So it doesn't really matter what you want to do. The ONLY way to legally remove him is eviction. So start eviction proceedings and then have the sheriff remove him.
