Law: Theft be charged or justt wastte of time?

My friend and I walked into a Korean resturant in Los Angeles. We did not order any food. We got water and a can of soda. My friend opened the can and that it. The waitress said we could not share rice so we walked out. Waistress said you need to pay for soda ansd I said you gotta be kidding me. We just left. Will they go to the police and could be charged with theft? Soda was at the most $1.99

Update:

As I said, no order placed. Just soda. I told waitress we wanted to share rice and oder a meal each. She said no can do. So we walked out after she told us no share.

They are not in the business of handing out free sodas. You are a thief and you know it. If they decide to call the police, you will be charged with theft.

You probably should have paid for the soda, but you're ok. They don't even know your names and even if they did they aren't going to bug the cops over 50 cents.

An order WAS placed and received. The order was only the soda, but you are STILL guilty of stealing the soda.

They could go to the police, but they probably will not in this case.
