How does an adult handicapped child become a ward of the state in Illinois?

My husband has a daughter, who is 36 physically, but around 8 mentally. His ex wife has sole custody, but she does not do anything beneficial for the child.

My husband provides medical insurance for her, but we were recently told that the child has Medicare, Medicaid, and SSI....

My husband feels he has gone above and beyond the call of duty, and he thinks she should become a ward of the state. How does he do that??

He probably can't do a lot about it other than reporting it to social services, since he doesn't have legal custody of his daughter. Just because she has additional state provided benefits doesn't mean that his ex-wife isn't doing what she needs to in order to take care of her daughter.

If the disabled person in question is not being kept clean, well fed and is living in a bad situation, i'd start by calling social services to see what can be done.

    I wish you well.

    Well, the first step is...

Both biological parents would need to die...

Of course, if your husband DIES, then you wouldn't be here asking about how your step-daughter could become a ward of the state...

Report the case to APS or the dept of social services . If there is abuse or neglect , they will intervene .
