If the landlord is too lazy to present a new lease each year,why does it go to month to month?What if the tenant wants to leave?

Update:

No, the landlord is actually lazy. This is not a facetious statement. The landlord would not fix a single thing within the home, and tried to blame me for everything. The roof caved in. The pipes were rusty. The tub was clogged with the paint chips from the spray paint she used to paint the tub before I even moved in. She couldn't remember anything. Not even present a lease. The only reason I stayed, was to save up to move. SHE was the jerk.

Update 2:

Too lazy to move? No. Try being disabled, and retired a retired teacher on a disability pension, a fixed income, and STILL faithfully paid the nut 1000.00 per month. I admit it was crazy on my part to continue to do so, but in good faith, I kept thinking it would get better. That never happened.

Update 3:

Since then, I have moved into a townhouse owned by a major realty company. This is way better than a private individual who bought a house at auction, and doesn't want to do major repairs. If anything needs repair, it is handled in a timely manner. I am paying only 50 dollars more in rent, but my electricity, water and gas bills, are lower.

Update 4:

The mold in her money trap was actually killing me. People like that should be reported. That's a slum lord. As soon as something goes wrong, such as the landlord not taking the time to notify you one way or another each year, as to whether or not they are renewing your lease,GET OUT!

Update 5:

I learned my lesson the hard way. I am sure there are other private landlords that are only concerned about just your money, and not their tenants. They make the ones that actually DO their jobs, look extremely bad.

    You are a good tenant and he has had no problems with you so, he is just leaving things as they are, on a month to month basis (which a lease automatically rolls over to). Instead of being a j*rk and accusing the landlord of being lazy, This gives them the options of raising the rent anytime. If tenants want to leave, they give 30 days notice once they are at the month to month, or 30 days before then end of the lease.

    It has absolutely nothing to do with laziness. It has to go with good faith. You are a good tenant and he has had no problems with you so, he is just leaving things as they are, on a month to month basis (which a lease automatically rolls over to). Instead of being a j*rk and accusing the landlord of being lazy, you ought to be glad that he considers you a good tenant. If you want to move out, just give him 30 days' written notice.

    If you dont sign a new lease, then you become a month to month tenant. You have to have a lease or not ... that is the law. That means you or they only have to give written 30 day notice to change anything. They can raise your rent or ask you to leave and you can tell them you will be leaving in 30 days.

    The lease is primarily for protection of the tenant. It prevents the landlord from tossing you out for no reason, raising the rent or changing the rules every month. It works both ways now: you can terminate and leave upon short notice (typically one month, maybe two), just as they can give you notice of termination at any time (depending upon state laws), without having to give any reason.

    Some states allow a lease to expire automatically, of its own terms, without allowing any "holdover" to a new month-to-month period. You would have been "put on notice" of your termination date at the time you agreed to the initial lease, and everyone would plan that you will be gone by that date, without anything else being said.

    It goes to month to month because they dont want it to expire completely. This gives them th options of raising the rent anytime. If tenants want to leave, they give 30 days notice once they are at the monht to month, or 30 days before then end of the lease.

    If the tenant want to leave after the lease expires, the tenant only needs to give a notice to vacate. Usually 30 days is sufficient.

    If you have no new lease, you can leave with proper notice, usually 30 days but not in every state.
