"Any type of personal relationship has the potential to result in the granting of favors. If the employee is a friend, significant other or family member, there’s a natural inclination for the boss to favor that person -- intentionally or not -- in some aspects. Trouble occurs when other employees feel they’re not getting a fair shake, or that the special treatment is unwarranted or undeserved".
I doubt it's illegal. They're family, so it's quite normal actually. I'd help out a family member working under me, wouldn't you?

Giving special treatment to relatives is not illegal for private employers (many businesses are family owned.)
But it's illegal for government officials to get special treatment for relatives.

If the Boss is not the owner and paying for the food himself, it is technically steeling from the company.

No. That would be like saying everyone has to be paid the same. Do you really think the government should be so deeply involved in how someone runs their business?

Probably not.
With that being said, I would make them pay if everyone else has to pay. There should be 1 policy. Either everyone pays or no one pays.
