Trespassing tickets on public parking garage?

Hey everyone. Recently me and ten other people got tickets for trespassing while we where having a car meet/photo shoot at out local public parking garage. The security guard on duty never came up to us and asked us to leave. The local cars and coffee have their meets there every other saturday as well. Anyways the security guard or "anonymous caller" called the cops on us. The cop came and gave us all tresspassing tickets for taking pictures of our cars. There are no no trespassing signs in the parking garage just no loitering signs. We weren t causing no harm or being loud. We where at the very top minding our own business. Was the officers reaction right or wrong? We all went to court and they said we can plead no contest and make a court date to fight the judge or pay $250 fine and take the violation. We all decided to go fight it. They said it was a criminal offense as well, which is just bs in my eyes. Can we fight this in court and win? This is in Oregon.

    Not familiar with local or state laws in Oregon, but if there were no loitering signs (actual local law signs with statutes and codes written at bottom) then hanging out and taking pictures would constitute as loitering. Not sure how the laws there define and separate trespassing vs loitering but good luck fighting it, hopefully you all can get off easy. I would suggest going back to the garage and taking pictures of the area to have pictures in court to show that there were no "no trespassing" signs etc.

    No, you'll lose. It's more than clear that such facilities are private property, and that you were not there for the one purpose that they are open to the public for.

    Frankly, any such group wishing to use such a facility for a meeting up with their cars should ASK the owners of the garage if the owners are OK with that, and to get permission for such use in writing. Otherwise, you ARE trespassing, and they don't have to put up notices about that, anymore than you need to put up such signs on your property.

    If you try to fight this, you WILL lose, 100% guaranteed.

    If you want a meet there you have to arrange this with the owners. There may be a charge.

    Cars and coffee meet organisers obviously have done this.
