I posted bail bond for son?
My son was arrested for assault on his x and was arrested. Spent a week in jail until I bailed him out.
He went to his hearing and pled not guilty so the judge decided to have a trail while the x was there.
My son told his story which was he was not assaulting anyone. His x had smeared shaving cream on his face and he rubbed it in his eyes. He could not see to defend himself. The x and Mama attacked son so he pushed them away and caused them to fall on their big butts. That's when the cops were called and son was taken to jail.
He posted bond and when he went to trial the judge found him not guilty and ordered the two to not have any contact with each other for a year, but he didn't get his bond back.
Shouldn't his money been returned since he was found innocent of the crime?

The money should be returned within 60 days. Call the court clerk.

You are confusing bail with a bail bond. Bail is set to insure the person shows up for trial. If you put up cash or in some case property to cover the bail it is returned to you as long as the person shows up at the trial. But most people don't have enough money to cover the bail so they get a bond company to put up the money. The bonding company usually charges 8% to 12% of the bail to put up the bond. That is a non refundable fee. After the trial the bonding company gets their money back and keeps the fee.

When you obtain a bail bond as opposed to posting cash bail you normally give the bonds person about 10% of the bail amount. SO if his cash bail or bond was $10,000 then you would give the bonds person about $1,000 - $1,100 for the bond. That is the fee the bonds person charges to issue the bond and it is not refundable at all.
Had you instead posted $10,000 (using the example numbers above) then the court would have returned the $10,000 when he was found not guilty.

I got my bail back but I had to go back to court with my son to ask for the money back. How dumb is that?

No, the money was to get him out of jail, does not matter whether he was found guilty or not, but check with bail bondsman to be sure.
