A friend was t boned. I want to see whos at fault.?

My girlfriend stoped at a stop sign at a 4 way stop, so all parties had a stop sign. She seen the other driver on her left start slowing down. Having confidence that the other person is going to stop she proceeds on and the other didnt stop or did a stop in go and t bones her hitting her driver side and causeing her to run into a wall and total her car. Whos fault do you think it is. We think the other driver is at fault but the other driver said she came out of no where. Who wins?

The fist vehicle at the intersection should have the right of way after a stop. If two vehicles arrive at the same time, the one on the right has the right of way. It sounds like the other driver was at fault. If there weren't any witnesses It might be hard to prove.

If the driver didn't come to a stop at the stop sign they are obviously at fault.
