When they do a background check they check arrest records. Any time you were arrested shows up even if charges are dismissed, found not guilty, or charges are pending. It is very unfair to search arrests considering there are people in this Country in prison or waiting to be executed that are totally innocent, how many more innocent people are still going through the system waiting to be judged? If the money is right and a private company does a background check, they could find the name of your first grade teacher and your grades that year if they wanted to,
In response to 0110 you are wrong. If you are arrested it is already a matter of Public Record.

There is no generic background check. That depends on how deep they want to go and how much money they want to spend on your background check. They can just check the county or they can check every county in pr. Pending charges can also show up.
If your application is asking only have you been convicted, you would answer no.

If a private company has the background check done then nothing that has not gone to court can show up since they only pull form public record.
Do you really think a background check doen for WalMart employment is as deep or extensive as taht done for a NSA sub contractor?

In general, In a background check they check the given state records for both felonies and misdemeanors.
Yes anything pending, dismissed, fine paid ( for any traffic or AI offenses) or sentenced will show up.
It depends on the type of job you are applying for. When I applied for Louisville metro Department of Corrections, they fingerprinted me for a NCIC check+ the FBI.
