How do I evict renters from my property if they don't have a lease in Arkansas?

Update:

I have given them several notices to evict and they will not leave and are never there or don't answer the door when I knock.

Since they don't have a lease agreement, can I take the city cop with me to set them out?

    NO. No lease does not mean no rules. With no lease you are still required to follow state law. A tenant cannot avoid eviction by avoiding you. When you serve a notice & they fail to vacate then you must file the eviction in court. You are failing to take that next legally required step. The police nor the sheriff will do anything without a court order.

    The sheriff will not do anything until he/she has a judge's order (called a bailiff's order) which gives them the authority to accompany you to the house to oversee an orderly physical eviction. In order to get a bailiff's order, you have to file for a formal eviction notice with the courts. In order to file this suit, you first have to provide the tenant with a pay or quit notice (you can do this by tacking it to the front door in most states (you don't have to physically hand it to them).

    The same way you would if they had a lease.

    If they haven't paid the rent, the process starts with a 3 or 5 Day Pay or Quit (whyichever is legal for AR). Then if they don't pay in full or move out, you file at the courthouse to have them evicted.

    A lease has nothing to do with eviction. If they are not paying rent you can give them a pay or quit notice. If you just want them to leave if they havent done anything wrong, give the 30 day notice to vacate. If they dont leave, then you get a legal eviction notice according to your state laws.

    if this is for non payment of rent, post a 3 day notice to evict, document it with dated pictures or the statement of a bonafide process server

    this might result in you taking them to court which will result in another 90 days but for non payment of rent you are likely to get a favorable judgement, the judge will order the sheriff to lock the doors on a specific date and the tenants no longer have access to the place

    If they are paying rent, they DO have a lease, month to month. Leases do not have to be written and they do not have to be long term.

    Give them a written 30 day notice to move.

    Notice to vacate, 30 days which begins at start of next rental period.
