Rented a room from some lady over Craigslist, no contract, do I still need to give a 30 days notice?

I was with her for 2 weeks and it was fine, and then she got a boyfriend and he is now living here. They play music loudly until 2 in the morning and have sex VERY loudly and VERy often (4 times in one day...I know because I heard it...) and wake me up. Now I need to move out if I want to get sleep, but it is the end of the month. I found a new place just today.

Do I still have to give a 30 days notice when there was no contract and she suddenly has a live in boyfriend?

Under the circumstances, I would tell her that the first two weeks went fine but the last two - with her live-in boyfriend, living there is unbearable. You are not getting any sleep, they keep you up until 2 a.m. and the walls are so thin that you have to listen to them having sex all the time - it just isn 't working out and tell her "I am sure you understand". Without a long term or written lease, you are automatically on a month to month lease so, you are supposed to give her 30 days' notice. Do so, if you can. If you cannot, tell her the above and when you will be leaving. If she says you owe her another month of rent, tell her you would pay if you could sleep but since you haven 't slept much in the past two weeks, you had planned on taking off work for two weeks and catching up on the sleep that she and her bf deprived you of so, under the circumstances, she isn 't getting it.

You had an agreement/contract even if it was not in writing.

Most if not all locations will treat you under month-to-month renter laws by default without a written agreement to the contrary.

Yes, you'd still have to give proper notice. In some locations if you have problems shortly after moving in you can leave without a waiting period (but you'd still need to give notice of what the problem is, and show the landlord isn't fixing it).

You need to consult a local attorney who knows your local laws. But you DO have a contract, even if not in writing.
