Can my legally married husband of 40 yrs. ,legally keep me from coming back to live in our house after being in the hospital?

I am going in for hip and back surgery, and he does not want to divorce me b/c of all the money he would lose, so he thinks he can get rid of me this way--can he legally in Texas?, And if he tries to do it by locking me out, what actions can I take to prevent this? Needless to say, we do not get along--he is retired,I am disabled and we are around each other all the time. CanI call the police to get back into my house? Right now,divorce is not an option for me and I want to live in my house--it is half mine.

    No, he can't. That would be an illegal eviction. Moreover, while Texas until recently still had common-law marriage, it has never had and there is no such thing as common-law divorce. They have to get divorced the same way everyone else does. But even a divorce wouldn't evict you from your property unless that were in the terms of divorce.

    You will find that the answer to questions like these, are determined by who has the best lawyer. Get one and get a GOOD one. Not a cheap one.
