Is it legal to have a waitress who is paid 2.13 an hour to have to do a long list of chores at the restaurant?

    Yes, it is legal. The restaurant has to pay the difference between the $2.13 p/h plus tips and the States minimum wage if the total does not meet or exceed that figure. The waitress or server is guaranteed minimum wage.

    It's legal. But I know where you're coming from. I used to work in a restaurant and the management used to load up the servers with sidework because we only got paid 2 something an hour. It's free labor for them.

    It was annoying and eventually it was the reason I quit and found another job. I was tired of being taken advantage of. That is your recourse. If you are being taken advantage of, find another job.

    If you (or someone else) is being paid $2.13 an hour than they probably hired this person under the table and is trying to milk them for as much money as they can. If the work is more than the pay, then walk away. Find another job that offers a bit more money. If this is the only thing you can get then you might have to stick with it. If the person is an illegal immigrant then this is probably all they can find. If you/they are a legal citizen, go find another job that pays at least minimum wage.

    The waitress is not paid $2.13 per hour.

    The waitress is paid at a minimum the state's minimum wage (or the federal minimum wage of $7.25)

    $2.13 is paid by the employer.

    The remainder is paid by tips unless there are not enough tips, then employer must pay the shortfall.

    As long as you are being paid, the list can be so long that you do wait on a single table your entire shift.

    Yes of course as long as the sum of the wages plus tips equals minimum wage or more for the total number of hours worked.

    Restaurant employees MUST earn minimum wage and if the tips don't get the total compensation up enough, the employer has to make up the difference.

    It would not be legal for the restaurant to pay the employee $2.13/hour to exclusively do chores (meaning they were not really a server).
