Which Small Claims Court Do I Sue In?

So we were planning a trip this summer. We live in City A. We rented a limo in City B in another state. Our plans changed and I went back to the limo company asking to return our $650 deposit. The company will not return our phone calls nor our emails. It looks clear that I will need to go to small claims court to recover those funds. Do I sue in my jurisdiction of the jurisdiction of the limo company?

    The limo company's jurisdiction, assuming that they don't do any business in city/state A.

    But maybe you will luck out, and find that the company DOES do business in city/state A. Then you can bring suit there.

    In City B but you aren't going to win. Most deposits are not refundable. That is the point of the deposit.

    You have to sue in the court that has jurisdiction in the area where the rental company is located.

    Read what you agreed to when you put down deposit. You may not be entitled to it back.

    You have to sue where the company is located at, so if you want to spend almost twice as much to go to that state and sue then go ahead

    First you will have to make at least 2 trips, one to file and then again for the court hearing. You can not claim travel expenses, lost wages, food, lodging or anything else.

    Then when you get to court and you win, so what, all the judge will do is order them to pay. Not on the spot, but in the near future (like 10 business days), if they do not pay, guess what? you have to make that trip 2 more times to file a contempt of court case, and then back again for the trial. Then if they do not pay, you will have to maybe have to make another trip back to settle the judgement, (petition the court for a bank withdrawal which will need a court order) and if they have no money-YOU GET NOTHING

    Did you make the deposit with a credit card? if you did, then you file a claim with the credit card company for a charge back which will (if you are successful) will withdraw the money from the business account back into your account.

    Are you sure (read the contract) deposits are refundable? Some companies have a no refund policy, they offer another date.

    So, if you want to spend probably 4 times more than what you are owed in suing, then go for it, but ask yourself is it worth it?
