The Eighth Amendment to the U.S. Constitution prohibits the federal government from imposing cruel and unusual punishment. Why do we do it?

    But you don't do it. That would be unconstitutional.

    Of course if you disagree with what the Supreme Court has defined to be cruel and unusual punishment, that's a different question.
