Child support in Texas?

My baby's father and I were together 10 years, never married. I got pregnant and he told me when our child was about 2 years old he wanted me to be a stay at home mom. I quit my four year job, and two months later he leaves me. Now we are in a custody battle for my child. I am not trying to keep my son from him but he told me he doesn't want to pay child support so he is trying to get 50/50 custody. There is a huge difference in the amount we make bc I just had to find a quick, low paying job when he left to keep food on the table. He makes 30,000 more dollars a year than me. Even if we had 50/50, wouldn't the judge still order child support? I want my son to see us both but I feel his dad is only wanting him for the wrong reasons and is gonna drop him off at the babysitters.

    Yes it is possible with 50/50 custody that you may still be entitled to some Child Support. Consult with a Family Court Lawyer for what may apply in your case.

    Don't knock the 50/50 back. Aside from the child needing to be with its father, you will also need a life. 50/50 is good for you and the child.

    Yes, even if you had joint physical custody awarded it very likely you would still receive child support due to the differences in your incomes. Keep in mind that when you upgrade your job from the one you took quickly just to keep food on the table that you need to inform child support about your change in income.

    There are two types of custody. Why does no one know that? There is legal custody and physical custody. Although you may get awarded 50/50 legal custody so that the father has some say in legal issues, you will probably get primary physical custody with visitation. That allows the father to spend time with the child, but it also gives you some child support.
