So they have to pay the penalty tax and that is regressive??????

The Federal Government has no legitimate authority to confiscate the hard earned assets of the responsible middle Class to give to those who are too irresponsible to provide for their own families. The States DO have that authority. (See: 10th Amendment.)
If the States Fail to properly care for their own citizens then it is time for the citizens in those States to vote out the corrupt and replace them with Competent public servants.
That is how the Constitution works. it is far more difficult to replace Federal Government personnel than it is to replace those in your own State.
Voters: Do your duty and Vote!
