Should I sue someone in small claims court if they have felonies and drug possession cases.?

Update:

I got into a car accident with an uninsured driver who was driving on a suspended license. I was not at fault so the case is clearly in my favor. I discovered he has history of felonies on his record, so is it worth pursuing him in court.

Will they seek revenge if they win?

    His criminal record is not the issue - driving with suspended license is a criminal offense in itself.

    The question is whether there is any chance he can pay.

    I do not understand why you do not claim from your insurance, and they take care of suing the other party for compensation on your behalf.
