Can I sue ex-landlord for property of mine missing little over a week after eviction?
We were evicted last Saturday and staying in a motel we just moved into a new home and we met up with the ex-landlord and her husband to begin retrieving property but a lot of stuff was missing such as our 2 google voice speakers we used for my grandma who is recovering from a broken hip and can't move around ,what should we do

If you have been evicted most state laws consider anything you left to be abandoned. Google "landlord tenant laws" and your state's name for details.

When people move out of apartments they very frequently leave stuff behind they don't want and it is discarded. Unless you have a agreement with the landlord regarding specific items you left behind he/she can probably discard them with impunity.

If you were evicted and left stuff behind, you are lucky you got any of it, it is all considered abandoned. When eviction comes and you leave, you take your stuff with you or it's abandoned, pretty much end of story. Your LL is doing you a HUGE favor by allowing you to get any of it.

From a legal perspective, your property should have been removed from the premises by the eviction date. Leaving anything behind was like saying to the landlord "we don't want this anymore."

Sure you could sue him but you don't stand a chance of winning. The Sherrif put your things out of the residence. It wasn't the landlords' responsibility to take care of it. It was yours.

In order to win a lawsuit against someone you have to be able to prove your assertion. Do you have any proof that they are responsible for the loss of your property? Was this property that you abandoned after moving out?
If you were not properly served the papers regarding your eviction proceedings, that'd be different issue. If you had been served and chose to ignore it until the final notice, then that's on you.

you knew before Saturday that you were getting evicted . you should have packed the stuff you needed . your fault for abandoning anything valuable . the landlord can charge YOU for the added cost to clean the debris from the apartment . he can legally deduct it from the security deposit .

I think you are required to have everything removed from the property by the day you are required to leave. Your property is considered abandoned.
