This guy you like is the only one with any responsibility for your ex's feelings and their friendship. He can decide for himself if he wants to date you and how to handle any potential issues with your ex. Your relationship wasn't serious and it sounds like the break up was mutual. It would be petty of your ex to get in his friend's way. Do what you want and don't worry about him.

Ex's friends should be off limits. If you're only talking you haven't really "fallen" yet. I wouldn't pursue him.
