Does the Americans With Disabilities Act cover temporary disabilities? ?

A friend of mine is having foot surgery and has to be off her feet for 8-10 weeks. She is a cashier at a gift shop. Her employer's policy is employees do not sit down during their shift. She could continue to work if her employer would allow her to sit on a stool, but they refuse to make an accommodation. Does this violate The Americans with Disabilities Act?

This sounds like a violation. She should seek help in the form of a friendly phone call to the boss from the government.

Yes, it does. She will need to get her doctor to define what accommodations she needs and for how long. A doctor's note is not a necessity, but they cannot refuse her if she has one.  The ADA is not Social Security.

I was on a call with the Great Lakes ADA Center and I asked this. I was told it would be expected as this is a no cost accommodation. The 6 month policy applies when major costly changes are required as part of the accommodation. It would not likely go to hearing, as the cost for a lawyer to fight the initial complaint would outweigh any benefits to the employer.
