How does someone who cannot breath be able to even shout out any words at all?

People can gasp and speak while having difficulty breathing - until they can no longer gasp or speak because they've died.

And it's breathe - not breath.

Why did he have to die for a crime he may or may not have been attempting? He matched a descpition of a person who was trying to commit forgery. Not that the cops were 100% it was him, he just fit a called in description.
