My girlfriend broke up with me but is refusing to move out of my house.  ?

We have an 11 month old baby.  She is saying we are not in a relationship any more but she is going to stay in my house indefinitely.   What can I do?

Do you own the house outright? If so, you have every right to tell her to leave and, should she refuse, evict her. But, are you heartless enough to evict your own kid?

    Realize that you're stuck.

If her name is not on your house deed, have the police and kick her out. You may have to get a lawyer and go to court, but do it.

Give her a legal 30 days notice down at the courthouse, so that she knows she must evict within 30 days

“Dewcoons”: he obviously OWNS the house, retard. In which case, he can kick her out, she can’t kick him out. It’s his property. She’s not entitled to free room and board in someone else’s property. The most she gets is a 30 day eviction period

Depends on where you live.  In most states, if her name is on the lease they she has just as much right to be in the house as you do.  Technically she could order you out of the house the same as you can order her out.

Even if she is not on the lease, if she can demonstrate that she pays part of the rent or mortgage, then she becomes a "renter" and you may have to go through an eviction process to get her out of the house.  Each state gives renters different rights.

In same states (such as California) even if she is not paying rent or on the lease, she has "squatter" rights, meaning that because you have permitted her to live in the house you have to go through the eviction process to get her removed.

If it is a rental, and you are not tied to a lease, you move and leave her stuck with the rent.

Does she pay the bills? Is her name on the lease or mortgage or anything? If not, call the cops and have her removed. Explain you're broken up, the house is yours, her name isn't on anything and she refuses to leave. Make sure to take your key back or just change your locks. She's essentially trespassing at this point.
