Yelp owner bashing me claiming I am a scam for bad review, has this happened to you? If so what was resolution? Or what would you do? ?
Hello all, I have been a yelper for a couple of years now, and this is the first situation I have where the business owner has started accusing me of being a scam, and getting paid to write a bad review. He is a gutter cleaning company and he came to my home got on a ladder looked at my gutters and started with excuses on why he couldn’t clean my gutters. First excuse was leaves are too wet. Second excuse was gutters are 2-3 inches wide wouldn’t be able to get it done. Then said you guys are better off doing them on your own. As a gutter cleaning company you would think those two things wouldn’t be an issue so yes I left a bad review upset he couldn’t clean them and stated the reasons why he couldn’t. I left the review right away and now all of a sudden 10 months later he decides to go on my yelp review and comment & accuse me saying I am a scam and I got paid to write this bad review and is also accusing me now that I have been found to “solicit reviews” which is all untrue. He is trying to discredit my profile of real legitimate reviews that I feel will impact real good businesses and I don’t like that. I give credit where credit is due and this young man cannot take that 1 star review for his life. I have reported his comment to Yelp support but was wondering if anyone else has experienced anything like this and what was usually the resolution or outcome?

In MY State there is case law involving Yelp reviews which a JURY decided were unfair. I personally question people who make a career out of Yelp reviews. Don't you have a life? I see NOTHING that he did that warrants a bad review. He didn't walk away from a contract, he didn't accept money and never show up again. He doesn't or won't clean YOUR gutters. That got your panties all twisted up?

IF this is a question of asking for an estimate and the contractor NOT accepting the job, yes, what you posted is defamatory. What YOU think is immaterial - the contractor has NO LEGAL OBLIGATION to work for you. It's just that simple, and his refusal to do the job is in no way "bad business."

Yes, you could be sued in MY State. The case I'm most aware of involved a Physician's office - and the woman who wrote the review lost the lawsuit.

Let them yelp all they want. If it really bothers you take them to small claims and sue them. They have to prove you have been paid and they cannot do so.

If you want to review a bad experience, keep it factual. Don't make any suggestions as to motive.
