Is it fair that because child support cannot be legally contracted out a women cannot use her ex husband sperm/fertilized embryos without ex-husband's consent?

A lawyer could probably get around the child support, but this ex is within his rights to not want his biological children out there in the world. This woman's being silly though as there's so much sperm floating around out there. She'd have no problem finding someone else's genetic material to make a baby with.
